Terms and Conditions

This agreement is governed by the terms and conditions below provided by A Rendezvous ‘Just for Singles’ (“we” and “us” and “our”) ABN 23 119 642 992. The Service is operated by A Rendezvous Group Pty Ltd trading as A Rendezvous ‘Just for Singles'. The terms and conditions of this agreement govern your use of the service.

1.0       DEFINITIONS FOR TERMS USED IN THIS AGREEMENT

Means these terms and conditions for the dinner event service.

Website
Refers to our website www.arendezvous.com.au

’ We’ and ‘Us’ and ‘Our’
Refers to A Rendezvous ‘Just for Singles’

Privacy Policy
Refers to the Privacy Policy for collection, use and storage of personal information and is separate from these terms and conditions.

Holiday
Refers to the any tour, trip or travel arrangement promoted by us.

Room Mate Match Booking Fee
Refers to the fee applied to a participant that has requested us to provide a match (same gender) with another participant for the purpose of booking a twin share room on a holiday.

Client or Participant
A person who has made a booking for one of our holidays via a licensed travel agent who has sign up to our agent incentive program.

2.0       USE OF THE SERVICE
After signing up to our travel agent commission program you may book our holidays on behalf of your client/s and in return be remunerated with a commission payment.

3.0       COMMISSION PAYMENTS
Commission Payments are paid in the first week of each calendar month after a client has made full payment on the holiday. Full payment will only be accepted once a holiday has reached minimum group numbers (as stated by a holiday terms and conditions) for a holiday to proceed.

4.0       BOOKING AND CANCELLATION POLICY
The booking and cancellations terms are conditions are unique to each holiday. 

5.0       SAFEGUARD OF YOUR LOGIN AND PASSWORD
It is your responsibility to keep your login name and password secure. It is also your responsibility to advise us if you know or believe there has been unauthorized use of your login and password. Our Privacy Policy is available separately to these terms and conditions. As part of our privacy policy, we ensure that all measures are taken to safeguard your personal information.

6.0       INTELLECTUAL PROPERTY
All content on this website including the text, material, images, graphics and advertisements are Copyright © 2006 A Rendezvous Group Pty Ltd. You may only view, download or print material for the purpose of selling a holiday.  You may not change, copy, reproduce, republish, upload to a third party, transmit or distribute this Content in any way except as expressly provided by us or expressly authorised in writing by us.

You must act lawfully when using this site and not violate any right of A Rendezvous ‘Just for Singles’ or do anything that is prohibited by the Terms of Use.

7.0       OUR COMMITMENT
In addition to our Privacy Policy we warrant that:


7.1     We act with all responsible care and skill when we provide the service.

7.2     We take all reasonable care to select tour operators and other holiday providers that offer good levels of service, however we are not responsible nor can we guarantee the level of service provided by those tour operators or other holiday providers. 

7.3     We shall endeavour to create holidays that have general appeal to single persons.

We warrant that we can not guarantee:

7.4     the compatibility of individuals who book our holidays nor the characteristics and behaviour of the participants on any of our holidays.

8.0       CODE OF CONDUCT
A Code of Conduct provides all participants in The Holiday with expected behaviour and helps to ensure an enjoyable experience for all participants. 

A Code of Conduct requires general courtesy and respect be considered for all participants.  A participant that is considered to be demonstrating behaviour contrary to the Code of Conduct will on the first instance be verbally advised by the holiday host or company representative that their behaviour is contrary to the Code of Conduct. Failure to curtail any behaviour contrary to the Code of Conduct after the first verbal advice may mean the participant risks having their Holiday terminated, without refund for any monies paid in part or full. 

Participants must comply with the Code of Conduct as below.

    1. We require that all participants observe responsible consumption of alcohol and obey all local, state or country laws pertaining to the consumption of alcohol and smoking.
    2. We require all participants to obey all laws of the country.
    3. Participants are to respect the privacy of other participants and if a participant declines to provide any contact information requested by another participant, that this is respected.
    4. Participants understand that if they receive contact information from another participant of the group event that this is solely for their reference and is not to be provided to other participants of the event group without the express permission of the participant whose information it is.
    5. Participants are to refrain from offensive language or behaviour including sexist and racist remarks.
    6. Participants understand that should other participants provide personal contact information that this information is not to be used for unsolicited email or correspondence for the purpose of business exchanges or transactions unless with the express prior permission of participants.

9.0       TERMINATION
The commencement date of this agreement is the date that you signed up to our travel agents commission program.

9.1        We may terminate this Agreement without any notice if you have breached any Terms or Conditions in this Agreement.

10.0     GENERAL
We are not responsible for any inaccuracies or errors in content on our website or in any of our communications whether a result of human, technical or equipment errors. A Rendezvous ‘Just for Singles’ reserves the right to change these terms from time to time.

Any complaint prior to an event or in relation to our service must be notified to A Rendezvous ‘Just for Singles’ in writing or by email as soon as possible. Any complaint during an event must be brought to the attention of the tour host or tour operator as early as possible during the holiday and if not resolved to your satisfaction, should be notified to A Rendezvous ‘Just for Singles’ in writing.

A Rendezvous ‘Just for Singles’ does not guarantee and will not be liable in respect of any delays and failures in the provision of our service beyond the control of A Rendezvous ‘Just for Singles’. Without limiting, the following shall be regarded as such circumstances: act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority, fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service, renovations undertaken by the restaurant, strikes, lockouts or boycotts, embargo, blockade. In this respect refunds will not be given where A Rendezvous ‘Just for Singles’ is not at fault.

To the extent permitted in law all conditions, warranties or obligations whether express or implied by statute, common law or otherwise are excluded and these terms shall apply in their place. None of the foregoing shall limit A Rendezvous ‘Just for Singles’ liability for death or personal injury caused by A Rendezvous ‘Just for Singles’ negligence in respect of which there is no limitation.

On any occasssion our maximum total liability to you in respect of any claim is limited to the higher of (a) AUD1000 or (b) two times the value of the land only component of any payment for a holiday paid to A Rendezvous ‘Just for Singles’.

Your booking is governed by NSW law and is subject to the exclusive jurisdiction of the NSW courts. The booking confirmation and these terms represent the entire agreement between A Rendezvous ‘Just for Singles’ and you.

Except as otherwise provided in these booking terms and conditions, your statutory rights are not affected.

Disputes arising out of or in connection with this contract which cannot be amicably settled may be referred to arbitration.
